Terms of sale

General Terms and Conditions of Sale — MyTomette

Effective as of 7 July 2026

Article 1 — Purpose and scope

These General Terms and Conditions of Sale (the “Terms of Sale”) govern, without restriction or reservation, all sales concluded between MyTomette (the “Seller”) and any non-professional buyer (the “Customer”) on mytomette.fr (the “Website”).

They apply to the exclusion of all other terms. Every order constitutes full and unconditional acceptance of these Terms of Sale, which the Customer acknowledges having read before confirming the order.

The Seller reserves the right to amend these Terms of Sale at any time. The applicable Terms of Sale are those in force on the date of the order.

Article 2 — Seller’s identity

Article 3 — Products

MyTomette designs and sells tiles made from Salernes terracotta, engraved to order in our Var workshop, in Provence.

The essential characteristics of each product (dimensions, material and personalisation options) are presented on the Website’s product pages. As terracotta is a natural material, slight variations in shade, grain, surface texture or size are inherent in the material and do not constitute a lack of conformity.

Most of our products are personalised : they feature engraving based on the information (first name, text, date, design or image) entered or submitted by the Customer when ordering. These products are made specifically for the Customer and produced individually.

Photographs and preview images are indicative; the actual result may differ depending on the screen used, its settings and the nature of engraving on terracotta.

Article 4 — Prices

Prices are stated in euros, including all taxes (TTC), excluding delivery charges. The applicable delivery charges are shown to the Customer before the order is confirmed and repeated in the confirmation.

The price charged is the price in force when the order is confirmed. The Seller reserves the right to change its prices at any time, it being understood that products are invoiced on the basis of the prices displayed when the order is registered.

For any delivery outside France, customs duties or import taxes may apply; these remain the Customer’s responsibility.

Article 5 — Orders

The Customer selects the products, enters personalisation details where applicable, then confirms the order using the “double-click” process: after checking the order details, the Customer confirms it by making payment.

Due to the personalised nature of the products, engraving production begins solely on the basis of the information entered by the Customer. The Customer is therefore asked to check the personalisation carefully (spelling, layout and preview) before confirming. Any request to cancel or amend an order after confirmation may be refused, as production will have begun.

The order is definitively registered only after payment is confirmed. The Seller then sends a confirmation email summarising the order. The Seller reserves the right to refuse or cancel an order for a legitimate reason (a payment dispute, personalisation contrary to public policy or infringing a third party’s rights, or a clearly abnormal order).

Article 6 — Payment

Payment is made online at the time of ordering, using the methods offered on the Website (bank card and other options shown at checkout). Transactions are secured by Shopify’s payment provider. The Customer warrants that they are authorised to use the payment method employed.

Article 7 — Delivery

Products are delivered to the address provided by the Customer. Delivery times communicated are estimates, calculated from production; as the products are engraved to order, preparation time is added to transit time.

The Seller shall not be held responsible for delays attributable to the carrier, customs formalities or a force majeure event. Under Article L216-4 of the French Consumer Code, the risk of loss or damage passes when the goods are physically handed over to the Customer.

If a parcel is damaged on delivery, the Customer is asked to record reservations with the carrier and contact the Seller (see Article 10).

Article 8 — Right of withdrawal and its exclusion for personalised items

Under Article L221-18 of the French Consumer Code, the Customer generally has a period of 14 days from receipt of the product to exercise the right of withdrawal without having to give a reason.

Exclusion — personalised items Under Article L221-28 (3°) of the French Consumer Code, the right of withdrawal cannot be exercised for goods made to the Customer’s specifications or clearly personalised.

Consequently, any product featuring personalised engraving cannot be returned, exchanged or refunded, including during the 14-day period, as the piece cannot be offered for resale. By confirming an order for a personalised item, the Customer expressly acknowledges that they waive the right of withdrawal for that item.

For any products that are not personalised, the Customer may exercise the right of withdrawal by informing the Seller of their decision in an unequivocal statement (email to contact@mytomette.fr) before the period expires. The Customer may use the model withdrawal form in the appendix. The product must be returned in its original condition, complete and in its packaging, within 14 days. Return costs remain the Customer’s responsibility. The refund is made within 14 days of recovery of the goods.

This exclusion does not affect the statutory guarantees (Article 9): manufacturing defects, damage on arrival or an error by the Seller will always be addressed.

Article 9 — Statutory guarantees

Independently of any commercial warranty, the Customer benefits from the following statutory guarantees, which no clause in these Terms may limit or exclude:

Statutory guarantee of conformity (Article L217-3 et seq. of the French Consumer Code): the Customer has a period of 2 years from delivery of the goods to bring a claim. The Customer may obtain repair or replacement of non-conforming goods or, failing that, a price reduction or termination of the sale. The Customer is not required to prove the existence of the lack of conformity during the 24 months following delivery.

Guarantee against hidden defects (Article 1641 et seq. of the French Civil Code): the Customer may bring a claim within 2 years of discovering the defect and obtain termination of the sale or a price reduction.

To exercise these guarantees, the Customer contacts the Seller at contact@mytomette.fr.

Article 10 — Complaints and customer service

For any question or complaint concerning an order, the Customer contacts customer service at contact@mytomette.fr. If a product is defective, damaged or non-conforming, the Customer is asked to report the issue on receipt, attaching photographs, so that the Seller can assess the situation and remedy it (an identical replacement or a refund).

Article 11 — Consumer mediation

Under Article L612-1 of the French Consumer Code, after sending a written complaint to customer service and if no satisfactory response is received within one month, a Customer acting as a consumer may refer the matter free of charge to a consumer mediator, under the conditions set out in Articles L611-1 et seq. of the French Consumer Code.

Article 12 — Personal data

The personal data collected is processed in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR). The Customer has rights of access, rectification, erasure and objection, which may be exercised by contacting contact@mytomette.fr.

Article 13 — Intellectual property

All elements of the Website (brand, images, text and designs) are protected by intellectual property rights and remain the Seller’s exclusive property. Any unauthorised reproduction is prohibited.

When submitting text, a design or an image for engraving, the Customer warrants that they hold the necessary rights to that content and grants the Seller a licence limited solely to fulfilling the order. The Seller reserves the right to refuse any personalisation that infringes a third party’s rights or is contrary to public policy and accepted standards of morality.

Article 14 — Force majeure

The Seller shall not be liable for non-performance due to a force majeure event within the meaning of Article 1218 of the French Civil Code.

Article 15 — Governing law and disputes

These Terms of Sale are subject to French law. In the event of a dispute, and after seeking an amicable resolution (Articles 10 and 11), the French courts shall have jurisdiction in accordance with the jurisdiction rules that protect consumers.
